Dear Friends,
Association Defenders of Adoption held a meeting last night to discuss the delays of the adoption files at the PGN. The audience was informed by the president of ADA, Enrique Urizar, of the contents of the letter that was sent last week by ADA to the director of the PGN, urging him to sign off all the cases that have been reviewed by the PGN lawyers and are waiting for his signature. The letter warned him that is he failed to do so, legal actions would be taken against him.
This past week, Barrios went to Bolivia and came back at the end of the week. This morning we were told he started signing off all files presented before May 15th. We assume that he is doing so, to prevent us from filing an Amparo (a legal resource where there is no other legal remedy) against him, for failing to give an opinion in more than a month. Although that is a good start, it is not enough. At the meeting, we agreed to file criminal charges against him, for not performing his official duties in the time that the law establishes (three days) and for sending many of the files for 'investigation' to the section of children and adolescents of the PGN, where the processes are paralyzed for many months. He has done a lot of harm and will have to answer for it.
For those of you who want to take an active role in the prosecution of Barrios, contact your lawyer and urge him or her to contact us. Criminal charges should be brought by the victims. Do not expect others to do it for you. Let us know that you support our actions and remember that united we will be stronger.

I can not express my gratitude enough for the action you and your orgainization have taken time and time again! I have been in PGN for 8 weeks and it is by no means the longest stay, it feels like a lifetime for me, missing my little guy grow up!!!! Our case has had no problems until this long wait in PGN. It seems that he will do the right thing now and I hope all the cases are released. We are so greatful to you Susan, for the work you are doing. Thank you, thank you, thank you. Although we are not in PGN yet, we are hoping that this will also end our long wait(4 1/2 months)for DNA authorization. Your involvement has been the answer to our many prayers and let's hope and pray everything starts moving quickly and children are united with their forever families very soon. We will do whatever we can to support this. I have already contacted our agency and asked them to contact our attorney. I'm waiting for a reply from our agency rep. Thank you once again.

I urge EVERYONE to contact your attorney and/or agency to take action. Together we can raise awareness and get this problem solved. I have no idea who my attorney is, but I am calling my agency this moment to find out.

Since reading all the news here about cases being stalled for months in PGN, I have felt great empathy for the waiting families, and dread for our family as we wait to enter PGN. I hope that there is news soon from the many of our cases that have been sitting idle for so long. For me, as I looked at the calendar this morning, it occurred to me that I have spent an entire season waiting for the PGN to act on our case.

Obviously this is great news for all. Thank you Thank you Susana for all of your efforts. You have thrown all of us and our waiting children a lifeline! I hate to be the bad guy here but what happens when charges are filed against the Director? Will he have to step down right away? Will this mean that there will be another long wait for a new Director? Won't this cause even more delays? Again, sorry for being so negative but we all remember what happened the last time there was a change in the Director's post.

I pray that we will also see some investigation releases. We have been in PGN since December and PGN investigation since around March.

Thank you so much!!!!! As a mother fostering her baby in Guatemala, unable to join my family in the states, this is the only news that has given me hope that our family will be reunited soon. My husband is waiting anxiously for his wife and daughter to return home and without this news we would still feel somewhat hopeless. We cannot tell you how much this news means to us! We are planning on contacting our lawyer immediately.

Does this mean... All files sumitted to PGN or files just presented to him? We were notified by our agency that we were IN PGN on 5/15/06. UGH!!! What does this mean for us!

Bringing criminal charges against the PGN sounds like it would not only cause a huge hassle and delay adoptions further but cause political strife that may end adoptions with Guatemala. And ruin the chances of any pending adoptions to be completed. So by speaking out for the current victims, you are creating many more victims. Is this what you anticipate happening?
Posted by: Amy at June 20, 2006 09:47 AMThe only reason that Guatemala is still open today is because legal action was taken against those who tried to circumvent the constitution of Guatemala. If it had not been for this action, adoptions would be effectively closed today...ie: the majority of the adopting parents reading this site, would NOT be adopting a child from Guatemala.
So, lets say nobody does anything....well, then don't count on these children ever coming home. The reality is that there is ALREADY a political tug-of-war down there or more like a game of chicken. "Bad relations" exist because adoptions are open.
Inaction, in my opinion, is about as effective as calling your agency and saying "never mind!".

We are new to the site and think is great. We´re in the middle of our adoption and thougth we were in PGN for months. Unfortunally, we found out about 2 weeks ago that we´re not. The Attorney lost a paper from our dossier and hadn´t told the agency.
We had to hire a supervisor in Guatemala to find this out. Thank God, we moved to PGN now and will wait untill these guys decide to move with cases.

There were a few exits for a few days and now it has gone back to a trickle again - did Barrios sign off on just a few in order to quiet everyone down, or does he not care if there will be criminal charges filed against him in order to satisfy his political agenda?
Also if anyone has made any progress regarding contacting the attorney in order to join in the procecution of Barrios - let me know I have mentioned it to my agency twice and was ignored!

This sight is very insightful and I visit it several times a day, can any one tell me where everyone is getting to information on the amount of cases comiing out of Pgn... there seem to be another web sight that is postings the amounts of outs and I would be interested in visiting that sight as well.
I was told today that my case made it into PGN today and this was very exciting for us but we where also told that the wait can be as short as 4 weeks or as long as 4-6 months. I believe in everything my agency says but i would love to hear of other cases coming in and out of PGN and time lines.. GOOD LUCK EVERYONE and any one whom may have a few PRAYER to spare send them our way and I will continue to pray for the babies waiting for there "FOREVER HOMES" God Bless

I really don't understand what is happening with PGN now. What happens when he signs off on the files that were sitting on his desk? Surely there are more files making their way to his office every day. Is he going to ignore those files? While my file went in on 04/17 it was kicked out on 05/29 and resubmitted on 06/14 so I am sure that I won't benefit from this latest threat against the director but I would like to see other families at least benefit and there seems like there was a little trickle of cases last week and almost none this week.

What is going on now? Weeks ago they said that criminal charges were filed against Barrios, the head of PGN. He supposidly signed off on some cases but it seems like we're back at a stand still. Why isn't someone doing something about this? This is truely criminal what he's doing to these children and the adopting families. Why isn't our government involved, why aren't all of the attorneys banding together to get him out of office, why aren't they getting these children out of PGN?

It has only been two (2) weeks since the attorneys met wtih Barrios, and discussed criminal charges. I have been keeping track of the families receiving final approvals from PGN since the meeting on the 12th. On this site alone, there have been at least eighteen (18) outs. In addition to those eighteen, my agency has at least four (4) more outs, and I've found several more on other forums/chats. These outs continued consistantly in to the second week.
I completely understand your frustration, and these past two weeks have seemed very long, when every time the phone rings, you pray that it's "THE CALL" we've all been waiting on. Our daughter is stuck in PGN, as well.
But... PGN is still releasing cases. It may be at a snails pace, but he does seem to be signing out cases, as he agreed to do. Although, I also would love to see the rapid results, if they can be obtained through making threats and demands. But... if they remove him from office, what kind of delay will we see then?? The delay due to the Hague Convention in 2003, was far worse than we're seeing now. Keep in mind, this is not the US Government. What seems to be an obvious answer for us here in the US does not necessarily work in Guatemala.
God's timing does not always fit our agendas, but please try to remind yourself that He does not only watch over one country, He is watching over all countries.
"When you bring these beautiful babies home, this time will seem minimal." This statement I have read over and over again written by parents who have previously adopted through Guatemala. Remind yourself, that you will have this baby for the rest of your life!

From everything I have read the May 15th date is really useless. I assume that he used the date in refererence to the cases that have been stuck in PGN for quite some time now (ie: since last year). I've been tracking the outs on several sites, and several outs were were submitted just after May 15th, as yours was. Do you have a receipt for your PGN submission. If not, you might want to ask your agency to supply you with one, just to settle your mind a bit.
I entered PGN originally on April 7th. We were kicked out on May 3rd with no PA and one additional form they were requiring from us that stated that we were aware of a medical condition she had received treatment for, and that we would continue to have her tested once home. We did not re-enter PGN until June 8th. So... my point is that we are in the same boat as you. I couldn't decide which date PGN would honor in relationship to the May 15th statement.
Several references I've been tracking are stating that the wait time for PGN submissions now is 4-6 weeks from the time you were submitted OR from the time your previos are corrected. Even Adoption Supervisors has made this statment within the last two days. So... I go by my later date of June 8th to count the weeks.
If you were truely submitted to PGN on May 18th, then you're in your sixth week. Maybe your call will come in the next few days, and the 4-6 weeks will stand true.
We must keep in mind that every case is unique in itself, and the averages may not apply. I will pray for you and your family to get "the call" that you are released from PGN and your daughter comes home very soon, and I hope to see a post by you when that prayer is answered!!

In times of such emotional roll-a-coaster rides, temptation to loose faith can be very hard to fight off. I read these comments several times a day, and my heart breaks from feeling the pain and anguish in a lot of the words written.
God is the ONLY ONE that is REALLY in control here! We as adoptive parents can not control our adoptions - regardless of how organized we are in completing the paperwork, how committed we were in researching everything before choosing our agencies, how persistant we are with getting answers or how determined we are in getting the PGN Director to do what we demand, or be removed from office. Man can build sky scrappers but man can not make a STAR!! The best thing that has happened to during our adoption process, is really "finding" God. Two months ago, I was very depressed, angery, you name it - and I wanted to blame the PGN Director as well. I have always believed in God, but never really got it. What were these people talking about when they said God spoke to them, or God opened doors for them? I yearned to understand that, but know now that I never got it. During the time of two months ago, I started reading a small book "Bedside Blessings" each night in attempt give myself something to settle my mind, and sleep. Night after night the short daily comments and scripture were trying to beat in to my head to give my worries to God, and that he was the only one in control, that he would tote my burdens when I surrendered to him in acceptance. I remember feeling so lost, and failing to find how I could help my daughter come home to us. At the time we were stuck in the Embassy awaiting PA, and I had been told it would be at least another 45 days. That night I was a wreck, and when I read my book, it told me again that God loved me - and that he wanted me to give my troubles to him, and I would find peace. That's exactly what I did, and the next morning COMPLETE AND WONDERFUL CALMNESS had covered my body when I woke. It's hard to explain in words, but I just knew that everything would be fine. I think my husband thought I had lost my mind. Other Christian friends explained that it was the presence of God. Then the next morning, I came to work to receive an email sent to me at 5:40 AM that we were released with PA only nine days only two weeks in the embassy. So back in to PGN we went.
We are still in PGN, but I don't feel the same as before. God has opened my eyes, heart and mind to a better understanding of the PGN delays and the PGN Director's position. I, too, was doing a lot of bashing "this man that was holding our children hostage for his own personal agenda". I don't like it any more than anyone else, that I don't have my daughter home yet, but I can SEE now.
Guatemala is not the United States. Only after our adoptions are complete and final, are these babies truely belonging to us. Until then, these babies still belong to Guatemala.
We have not been granted "rights" to these beautiful babies through our paperwork and money - Guatemala is "allowing" us to adopt these babies out of their country. But... Guatemala does have the right to protect these children and determine if approval will be granted to each family. After all these are still their children. I know that I would rather have an ethical and moral adoption, in stead of a speedy one. I don't think the PGN Director has a personal attack on the US adoptions - but the more I read, the more I'm convinced that some of us have made it a personal attack on him. I just don't feel like the negative actions and comments will make this process move any faster, and it may just drive us crazy in the meantime.

I was telling my mother about the problems with PGN and the legal action that has been threatened against him and so on. At some point through the conversation she said "be careful what you wish for" and I have to say after thinking about it I am concerned with the legal action. I remember there was a long delay when the new PGN director started in April. If he is removed from his position it is very possible that our cases could be delayed even longer. We only know of our own cases still in PGN but there are new cases entering every day and if the director is removed because of legal action can you imagine the effect this will have?! I am very nervous about adding to the already existing problems.

Is it really possible to get a receipt of the actual date my daughters paperwork was submitted? I am really worried because when we submitted the paperwork for the pre-approval it took almost a month. Later we found out that the pre-approval was done one week prior, but no one had went to pick-up the paperwork. It was just sitting there waiting for pick-up. How frustrating is that?

I so appreciated your comments. As I have read and read these comments, day after day, and came to the conclusion . . no one has ever said anything regarding God being in control. To all of you reading on a daily basis these comments, let's pray for the release of these children everyday at 11:00 a.m. Regardless if your on standard/central/pacific times. Let's see how God can change things in Guatemala.

First... when we were put in to the embassy for PA, our agency gave us the email address to the embassy, and instructed us to email the embassy in two weeks and "politely" request a status update. I did just that. The embassy emailed back almost immediately with a "polite but direct" email that they had received our paperwork, and that they had 30 days to process it. It was only a few days later that I received the email from the embassy that we were released. Then I forwarded the email to my case manager, and they forwarded it our attorney.
How were you notified? By your agency or the embassy. I've heard it both ways, but the most efficent seems to be the email from the embassy. I was just curious to who really held it up.
As far as the receipt of PGN - your agency should be able to get that receipt from your attorney. I have been very happy with my agency, but I talked to my case manager about the receipt last week. She said that they used to "always" supply a receipt, but had gotten away from it, since they had really not experienced any hold ups since 2003 due to PGN. She said that she could get it for me.
Have you asked your agency for the receipt?

Thank you so much for the information. I have gotten more information from this web-site then my agency. I also had to email the embassy about the status of our pre-approval. When they emailed me back, they said that the pre-approval was complete, and that it had been waiting for pick-up since April 24, 2006. However, it was about May 15, 2006 at the time. This is the reason that I am so afraid. What if it's sitting there and no one is there to pick it up. I don't know, maybe I am worrying to much, but can you blame me. Yesterday, I called my agency and ask for a reciept of the actual day that my daughters paperwork was submitted. Needless to say the entire conversation made me feel very uncomfortable. I had hoped that I would hear from here from the agency today but never got a phone call. Oh well I guess it will be another week of waiting. Thank God I Have my work to keep me busy or else I would go mad.

I'm wanting the same info.
We have been in PGN for almost 4 months now, so I'm ready to take action myself if that is what it takes!!A friend of mine adopted last year from Guatemala and had to use a AS. I would like any info. on this,and any referals.Our little girl is over 9 months now,with all expectations of getting her at 6 months.Can someone please help?

Did your agency say they WOULD get your a receipt?? Just curious!
When you do talk to your agency, ask them how often your attorney's office goes to PGN for updates on who has been released and kicked out. I was talking with my case manager yesterday, and, before I had a chance to ask, she told me that my attorney visits PGN EVERY DAY!!
Hopefully, with all the problems with PGN, your attorney is doing the same. One thing my case manager said is that she knows the families feel like they are doing nothing, but they are checking on the cases EVERY DAY.
Maybe after the holidays, he'll get to signing, signing and signing some more!!!!

I noticed you mentioned that your friends used an AS and that you might do the same. Is that some type of additinal Attorney to work on your behalf. Whatever it is, I would like to know more information about it. We have heard a few things about hiring additional help in Guatemala. Any information will be greatly appreicated.

Something that is supposed be so special has turned out to be one of the most depressing upsetting and stomach turning events in my life. How sad? I do not sleep I can hardly eat my stomach is in knots. I have been in PGN since 3/24 it is now 4/5. We had a holiday here but there was no holiday in Guatemala. I have no problem getting my social worker on the phone but I do have a problem getting my program coordinator on the phone I think she forgets what her job is. I am going to call her today and ask her opinion about using an adoption supervisor. Anyone else's opinion would be greatly app..........
