Waiting Angels Plea Deal

Guatadopt has learned that Joe and Simone from Waiting Angels today accepted a plea bargain with the Michigan Attorney General's office. Under the agreement, they will plead no contest to the felony charges. Their sentencing hearing will be held on April 8 and it will be at that time that any restitution to their victims will be announced.

As part of the deal their website was ordered shut down (which has already occured) and they are forbidden from working in adoptions until they have completed any probation that will be part of their sentencing.

We applaud the efforts of the Michigan authorities on this matter. Compared to the pathetic response we have seen from states like Minnesota, South Carolina, Florida, Pennsylvania and North Carolina when corrupt adoption agencies are brought to their attention, Michigan seemed to have cared more for its citizens. And if the AG's from those other states listed want a better Guatadopt rating, give us a call so we can help you bust the scumbags!

Let's hope more people come forward and get the rest of the agencies, facilitators and lawyers who are doing corruption in this country and abroad out of the system.

I did not say anything happened in South Carolina. Just that there is an agency there that authorities have received numerous complaints about and to my knowledge they have done nothing.

I think it is very important that you get ALL information correct before posting publically. I think the public has already been deceived enough regarding many FACTS in the case of Waiting Angels and how the State of Michigan handled this. Waiting Angels did NOT plead no contest to felony changes pertaining ANYTHING to do with adoption fruad or scam. As a matter of fact, the courts saw that this did not happen. They saw the agency as a good agency that brought home over 60 children. What everyone does not mention here is that what started this whole "investigation" was a family crying out that they did not have a baby and that they were being scammed . In the end not only was this lady misleading the public and state investigators, but the adoption actually was finalized and the baby was ready to come home, but yet the family ABANDEND the child and refused to pick up!!! I don't think anyone knows the truth about all the comments that "ticked" was saying all along.
According to what I heard, several families were willing to readopt this child once the child got home to the States but the family refused. If anyone committed a crime and was scum..it was the family that started this whole mess with Waiting Angels. Please get all your facts straight and let everyone know. Waiting Angels DID accept a no contest plea, but it has NOTHING to do with rico charges or adoption scam!

Anyone who would like an outline of what the Waiting Angels families did to finally get charges filed, please let me know. No promises that another state will react the same way, but maybe with the example that has now been set, other states will be more likely to pay attention and actually do something about people like this!

You need to do the same. Do you even know how many families have been suffering because of Waiting Angels? I'm glad they are paying the price. This trial obviously had something to do with adoptions or Joe and Simone wouldn't be willing to give money back to the clients that do not have babies home.
So... what you are saying Cin, is they are corrupt people not only in the adoption business but in other areas as well???

Cin, you are sorely misinformed. Joe and Simone accepted a plea agreement, admitting they were guilty. Until the hearing on April 8th, information is not being released by the AG's office. My info and Guatadopt's info is coming from reliable sources.

Also, readopting this child is not as easy as you believe. It is an incredibly complicated legal process. There were negative consequences for the PAPs and what you suggest is possible simply could not be accomplished. To protect the privacy of both the child and the PAPs, it isn't a matter than should be discussed on Guatadopt. You are not privy to the conversations between the PAPs and their legal counsel. The PAPs are also under no obligation to discuss a very private and legally privileged situation with other PAPs who are making unfair and inaccurate accusations. From what you wrote, it appears you have been given extremely inaccurate information. Your personal attack of these PAPs based on bad information has no place on the Guatadopt forums. Or any other PAP forum or blog for that matter.

Personally, I am appalled to see this message on Guatadopt, which is supposed to be a place of support for PAPs.

While I don't know the exact circumstances being described and agree that is no place to bash any PAP, I do want to point out a legal thing.

When you do your embassy interview, you swear under oath that your intention is to raise the child. To complete the adoption and immigration paperwork to bring the child to the US with the sole intention of adopting the child out domestically is visa fraud.

Lastly, since the comment did not name the PAP or add any identifyng info, I let it go. But we won't allow it to be posted if it does identify the PAPs.

Is there a double standard about what we'll allow about PAPs vs Adoption Service Providers? Maybe, but identifying the agencies helps other PAPs and is of value. Naming a PAP serves no purpose except trying to villify someone.

According to the Michigan AGs office, I was informed that Waiting Angels accepted a no contest plea to tax charges only. Part of the plea was for the judge to decide the amount of restitution, if any is to be paid.

I understand some families have been hurt, but not all adoptions through Waiting Angels were bad..My daugter came home at 6 months, happy, healthy and very well taken care of, through Waiting Angels.
I would love to have that same process again considering the NIGHTMARE adoption we are going through now with a "better" agency.
Bottom line is the gag orders need to stop and adoptive parents need to speak out good and bad about agencies... To much is hidden that comes to light AFTER you sign on the dotted line....If people would speak up it would save many more future clients a lot of heartache....

For those of you that are interested and to correct any misinformation about what Joe and Simone pled to; they pled No Contest to one count of Tax Fraud with an agreement that the charge will be reduced to a tax misdemeanor after one year. The felony charge of Conducting a Criminal Enterprise was dismissed by the State. The Judge will hold a hearing to determine if any restitution is owing and if so, what the amount is. Under terms of the agreement, if they are not involved in criminal activity in the next year, they will each end up with one tax misdemeanor.

I wanted to address a few of the things that you brought up in your recent post, and correct some inaccuracies.

First, when referring to what recently transpired in the court room, you made mention that the defendants plead no contest to a charge unrelated to adoption scam charges and that "the courts saw that this did not happen", and that "they (the courts) saw the agency as a good agency that brought home over 60 children".... How many children were "matched" that never made it home? Where did you get your information? How would you know what the judge thought unless you were in chambers while these issues were being discussed? The charge that they both plead no contest to DIRECTLY relates to fraud and misleading potential clients. The Attorney General's office does not issue charges based on one emotional persons complaints. There were multiple families involved in the criminal case, and will be even more involved in the upcoming civil case. Were you planning on bashing all of the families involved or just us? Every claim that I have made can be backed up with paperwork, and in no way are we sorry that we made enough noise to finally get someone to listen. Many other families had tried but given up when phone calls were unreturned or they were told that the office needed a Michigan family to initiate action.

The attempt to adopt the child from Guatemala was started in June of 2005. We came to the painful decision not to continue more than 18 months later and almost a full 10 months before we were notified that the case had been released from PGN. Apparently someone took it upon themselves to continue processing the case without our permission or consent. At the point that we were notified, we had already submitted paperwork to attempt to adopt through another agency. Legally, we could not continue on both paths. We were contacted by TWO families (not "several" as you said) that they would be interested in adopting this little boy who was now 2-1/2 years old. We immediately drew up papers and sent them to Guatemala to have this child released so that he could be processed for his new family. We NEVER ABANDONED this child!! To imply otherwise just reveals that you are only receiving one sided information that is obviously misleading. We did not refuse to pick this child up, because the case had not progressed to that point. We have done all that we legally can to ensure that this child will not be lost in the hague shuffle, and have received confirmation from the facilitator that he has received the necessary documents to process the case for another family. The case had reportedly been released from PGN although we have to question how this happened since most of our paperwork was 2-1/2 years old and when other cases were getting kicked out for very minor things, how could they have let this go through? We have our presumptions....

The RICO charges as well as others will be involved in the upcoming civil trial which you can find on the attorney's website should you feel like educating yourself to another point of view.

Like any agency out there, Waiting Angels had clients who were both happy and angry with their service. And we do encourage everyone to post their opinions of them in this regard.

BUT…..

Whenever one of these scandals breaks, there is an immediate reaction to attack those levying the complaints. Guatadopt will have no part of that and are in no position to judge what anyone should or should not have done in their unique situation.

I also want to say from experience having dealt with hundreds of families in tough boats that it is wrong to judge PAPs nine times out of ten. “We” often don’t get 100% of the scoop and more importantly, none of us can put ourselves in someone else’s life situation.

So dear readers… I will NOT be approving any comments on this thread that address individual circumstances unless it is someone talking about their own case and experience. Sorry to anyone who this upsets but it’s the way it will be. No other Guatemalan adoption internet resource allows as much as we do to be posted so I don’t feel much guilt about this.

To all who had positive experiences with Waiting Angels, please know that others had a much different experience. That does not demean your experience; it just says that you need to be sensitive of others. Waiting Angels did plead no contest to crimes and we all know what that and any plea deal means. Joe was caught on tape broadcast on TV admitting to various unethical and possibly illegal practices. The authorities found hundreds of thousands of dollars in cash in their home. Waiting Angels claims that money was not from adoptions but who that is on the up and up keeps that kind of cash in their home? So to me, it seems hard to defend them. Just my opinion….

Please don’t put me in the position of having to reject comments.
