UPDATE 5/21: We have only received a dozen or so forms and we know many more such cases are out there. We will keep this open until the end of the week and then send the info on. Once we do, we will not be accepting any more forms.
The link you'll find by clikcing on more will take you to the form we have created to develop a database of abandonment cases that could not be registered with the CNA. Please only fill this out if you were matched with a child whose case was (or still is) in the abandonment process when the new law took effect AND it thus could not be registered with the CNA.
There are no hard core who can and can't fill out the form. So please use your best judgement.
We will be providing this information to the CCAI and CNA or other governmental authorities as needed. By filling it out you are giving us permission to do that. We will keep this open until May 19th before sending out the info.
We can't promise anything, but we know that officials have been wanting to know who was in the situation described above.
IMPORTANT THINGS:
1.) Please double check everything before you submit. This is going directly into a database. We do not have the ability to manage making manual corrections to the databse. duplicate submissions will also be an issue.
2.) Please send pictures that clearly show the child's face and if possible no one else
3.) The picture file name should be the child's full name. Otherwise we won't know who is who
4.) Don't worry if the reply you receive back seems to miss some of the fields. We are getting everything.

I am trying to decided if we should fill this out. CNA is giving us the option of doing a national adoption. We have lived in Guatemala with legal residencies for several years. We are seriously thinking of doing this.
Our only drawback is the USE.
Does anyone know if we will be able to get a visa for our child when we are finished?
Any insight or advice is greatly appreciated!

we are in the process of an abandonment case too with our second hearing being June 4. We were told that we could move to Guatemala for two years and do a national adoption. Unfortunately, we are not in a position to live in Guatemala for two years. However, we were told there could be some difficulties in getting the child back in the US once we did this because it would not be a Hague compliant adoption. I am not sure that I understand that as we didn't investigate any further because it was not an option for us. We have decided to hope for the best and continue with the process under new Guatemalan law (we were registerd with the CA before the deadline)and old US law which means processing under the old I600-A but not the new I800A. The biggest concern right now is the link between our son and us once he is declared abandoned and the CA keeping their word on what they are saying. We all know that nothing is official yet.
With respect to the non-registerd case with the CA, my guess is that you would have to wait until Guatemala becomes Hague compliant before you could register with the Central Authority in the US. Currently, the US is closed to Guatemala until they become Hague compliant. My understanding is that you would have to process under the I800-A but you can not fill that out until Guatemala has met the Hague compliant steps. We understand that they are working on that now with putting the system into place and have already hired outside consultants who have worked in other Hague transition countries to help establish the laws.

Thanks for posting the abandoment case form, hopefully this will help track the ones who are caught up in the abandoment processes. Our son is still waiting for his second hearing for his abandonment and then we have no idea on what the next step will be. We also would not be able to live in Guatemala for two years to complete an adoption. We have to hope and pray that they will take us in consideration since most of the ones that are in abandoment process have been trying to get thier children home for several years. Make sure you keep your I-171H valid and do not let it expire - that grandfathers you on the US side for your I-600 if Guat lets us move forward in the near future. I have a COA as of Feb and was not able to register with CA b/c we did not have it in time. I have filled out the form as my lawyer said it will not hurt and may help.

Have you heard yet if there are any data base forms for those of us who received a referal,, but were not an abandonment,, and are totally considered an active case on the US side, but barely missed the deadline to register in Guatemala ?

I had heard that if the child is issued an COA right now, the CNA can take over the adoption and they will try and find a Guatemalan family for the child. So... should the lawyers wait or continue with the hearings so the PAP will be ready to continue with the adoption if we are allowed to? Does this make sense?

Topic: alphabetical order for BM interviews?
I can't start a new topic but something has just occured to my husband. Perhaps the PGN has set the clock back on 22 April and they started the BM interviews in alphabetical order. I'm wondering what's going on because we entered PGN in December, had our second review on 26 March, and still we haven't got an interview scheduled.
Our baby's surname begins with P - bad news if the theory is true. It would probably be the name on the front of every dossier, and it is the kind of arbitrary thing they would do.
Could the people who have had their BM interviews tell me their babies' surname initials? (No need for names.)

We accepted our referral 13 months ago, in April. Our birth mother disappeared. In December we asked our agency if enough time had passed to go for a COA. At first they said yes, but then after conferring with several attorneys in Guatemala, it was advised, due to the impending changeover, that it would not be wise.
So at that point, our only recourse was to continue pursuing the birth mother. After several more months of a private investigator searching for her with dead ends at every turn, we've now been told that our only option is for our new attorney to plead with the CNA to allow us to proceed with abandonment as a grandfathered case under the old process. We WERE registered with the CNA in February.
Now because of the mess down there, we're at a standstill with no answers. As of right now, we're not officially an abandonment case, so I'm not at all sure if we should fill out this form. Please advise.

Re. alphabetical order - I think the theory's wrong. I've had a few replies here in the UK as well, and there have been Ss and all other letters. Oh well... worth a try!

Therfore; I took it upon myself to call the PGN offce and ask about my case. I also was told that I was in the 2nd review. Can someone tell me what that means? How many reviews are there? I am also concerned because I am reading that many of you are calling the PGN office and being told the same thing. Are we really in the 2nd review? Are they just saying this?

My cousin, who is proficient in Spanish, spoke to someone in PGN for me, asking my questions. We were told that we, too, are with the 2nd reviewer, and that we should have the "final signature" in 2 weeks... It's funny that everyone is with the 2nd reviewer- no wonder things are backed up!
